Technical Performance and Optimization Warranty
Anamaji specializes in Image & Asset Optimization, Database Cleanup, Headless Speed Overhauls, and SSR Setups, which involve deep-level modifications to your website’s architecture and code. While we strive to achieve the highest possible scores for Core Web Vitals (LCP, FID, and CLS), you acknowledge that third-party factors such as hosting provider limitations, external scripts, and user-end hardware may influence final performance results. We provide a professional warranty that our optimizations will follow industry best practices, but we do not guarantee specific numerical scores on third-party auditing tools like Google PageSpeed Insights, as these metrics are subject to external fluctuations beyond our control. Client approval is required before major database or server-side changes are implemented, and Anamaji shall not be held liable for pre-existing code vulnerabilities or hosting instabilities.
Intellectual Property and Work Product
All proprietary engines, custom scripts, and code “cleanup” methodologies used during the performance of our services remain the intellectual property of Anamaji unless otherwise specified in a separate written master service agreement. Upon full payment for our services, the client is granted a non-exclusive, perpetual, worldwide license to use the optimized code and assets integrated into their specific website. You may not reverse-engineer our specialized optimization engines or redistribute our proprietary performance frameworks to third parties without express written consent. Any content, logos, or brand assets provided by the client to Anamaji for the purpose of optimization shall remain the property of the client, and Anamaji claims no ownership over such materials.
Limitation of Liability and Indemnification
To the fullest extent permitted by California law, Anamaji, its directors, employees, or agents will not be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, or loss of data arising from your use of our speed optimization services. You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, or claim, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party. Our total liability for any claim arising out of these terms shall not exceed the amount paid by you to Anamaji for the specific service in question during the six months preceding the claim.
Professional Service Fees and Refund Policy
The fees for our “Speed & Core Web Vitals” services are determined based on the scope of the project, including the complexity of the headless overhaul or the size of the database being optimized. Payments are due as per the schedule outlined in your specific project proposal or invoice. Due to the digital and labor-intensive nature of technical optimization, Anamaji maintains a strict no-refund policy once the technical “cleanup” or “overhaul” process has commenced. If a project is cancelled before technical work begins, a partial refund may be issued minus any administrative or consulting fees already incurred. All financial transactions are processed securely, and any billing disputes must be submitted in writing to contact@anamaji.site within thirty days of the invoice date.
Governing Law and Dispute Resolution
These Terms and Conditions and your use of the site are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding related to these terms shall be brought exclusively in the state or federal courts located within California. You agree to submit to the personal jurisdiction of such courts for the purpose of litigating all such claims. In the event of a dispute, both parties agree to first attempt to resolve the matter through informal negotiations for at least thirty days before initiating any formal legal proceedings or arbitration.
